May I be excused? My brain is full!

I think the only thing that's kept me sane while working on my Summary has been the bits and pieces of my prof's humour that I've come across. I think I might have killed myself if not for her dry wit.

heathers: rec me something you've written, here in my LJ. And then go forth and ask the same in yours.

Oh, and because you asked, Sarah, here's some slightly closer up pix from our trip to Toronto. You can't see me and Justin very well, but at least Daniel and Chris show up nicely :)
I think the only thing that's kept me sane while working on my Summary has been the bits and pieces of my prof's humour that I've come across. I think I might have killed myself if not for her dry wit.
- Talking about the case of Anglia Television v. Reid (Reid backed out of an acting contract, Anglia couldn't get a replacement in time):
Classmate: Well... I mean, Robert Reid, that's the dad from the Brady Bunch, right?
Prof: Yes...
Classmate: Well, not to besmirch his reputation, but... he's not exactly Laurence Olivier, is he?
Prof: Well, no. (pause) Now, Alice, on the other hand... - Jarvis v. Swan Tours (Jarvis was promised a wonderful vacation in Switzerland, complete with skiing, pastries, and yodelling. The vacation was awful and he sued for loss of enjoyment)
"It's hard to quantify loss of enjoyment, because it's very subjective. I mean, some people might be thankful for the lack of yodelling. Like I'm always thankful for a lack of bagpipes." - (some random case)
"Well, and then there's words exchanged, and then it becomes a slapfest, and then before you know it, you're Mariah Carey." - (Talking about seals, and what's considered a seal)
"So it doesn't have to be a wax thing any more. It can be a blob with the word "seal" next to it. Some of us use stickers, some of us just use a circle - never put a happy face, though, that's really frowned upon." - (About to introduce a sequence of cases that all deal with sailors modifying contracts at sea)
"... and the reason these are my favourite cases is that they're pirate cases! Yo Ho Ho!"
"I mean, who wouldn't like a doctrine of law that arises out of piracy?" - (comparing another case to the above)
"And the Court held that there's a difference in situation between building a hockey arena and sailing from thither and yon, yo ho ho." - (Re possible legislative change to an area of contract law)
"Well, yeah, that's what I'll tell the government when they come to ask me my opinion. (pause) Which they so won't! I mean, the Right is so not coming to ask me my opinion on anything!" - "Pure Economic Loss. (deep sigh) Our Dean is an expert in this area of law. Which is why he makes us teach it."
- "Yeah, you generally can't write 'Ground 1 for Appeal: they changed their mind, I got screwed.'"
- Laing Property v. Allseasons Displays
"So now we come to Laing. Which is very tragic, because, of course, it's Santa's Castle that burned to the ground."
"So the mall tenants sued, and the defendants third-partied the landlords, and the employees - I guess that would be the elves..."
"So the issue is: are the elves protected as third parties in the lease?" - "And then they write this letter. (Pause, chuckle) Never write a letter that says you're shocked. Never say you're appalled, either. Never be appalled."
- "So then they sent this by mail. Which may seem quaint to you all, but they did. It was a method of communication, you see."

We had this one, too: "Under the King's Peace" in the definition of murder, which really means "within the jurisdiction". But the head of Criminal Law was an expert in it, so we were supposed to spend an entire class on the Murray River and Tweed Heads cases (murder cases where it wasn't clear which state the murder happened in). No one except me (a resident of the Vic-NSW border) really cared...

And the Rec: part of my "Returning Saga", it's my one-and-only courtroom drama to date. It's lengthy, but I'm proud of it.

Date: 2003-12-03 11:23 am (UTC)So. I've downloaded, and am holding it out as a treat for after I'm done my *&%$* Contracts exam. Along with another Voyager story of Cassatt's.
By the way, I noticed that in Trial Separation Pt 1, all the text is underlined, which it isn't in the rest of the series. And the link at the bottom points to
http://koffeeklub.net/sangerin/returning2_pt1.htm
instead of the Trial Separation Pt 2.

Good luck with Contracts! I remember how much I hated that subject.
