Privacy includes being left alone and permitted to exercise one's own will over an object which is owned that's why it's called private property as opposed to public property. If the police steal someone's shoe that is theft because there are private property rights associated in it, and one has a reasonable expectation of privacy in the shoe.
There's nothing really wrong with the above, other than a run-on-sentence at first, but for some reason it brings to mind a bright twelve-year-old writing for a grade eight Civics class. Not a lawyer writing a Constitutional factum that is then posted onto a website to help other lawyers write Constitutional factums.
Not to mention, "one has a reasonable expectation of privacy in the shoe" makes me snicker. As does "The Crown argues that there is no reasonable expectation of privacy in the shoe."
And also? "Twaddle" is a really, really unfortunately name for a judge.
