Post-Discovery #2
Oct. 5th, 2011 04:24 pmThe defence's second kick at the can for the 10-year-old lawsuit. The ostensible reason for having a second discovery was that so much time has passed since the first one (seven years, in fact) that they need to "update" their facts. The fact that it's their fault that it's taken this long apparently doesn't matter. In any case, it's not the real reason for Discovery #2. The real reason is that the previous lawyer on the case never bothered to order a transcript of the first Discovery, and the reporter's notes are destroyed after four years, so they've got huge gaps in their facts.
Started to actually feel sorry for the poor guy on the other side, as our lawyer kept telling us not to answer any questions that they should've had answers to. So "How has your marriage been since 2004?" was an appropriate question. "How was it right after the accident?" No dice.
And some of the questions... ugh. Not the other lawyer's fault, but questions like, "Is Chris's parenting different now compared to before the accident?"
Well, duh. Yes. Of course it is. Accident aside, a few things have changed between now and then, what with ten years having elapsed. We now parent a teenager. Both our kids are now verbal, and both have bowel control. That's the kind of thing that happens after ten freaking years.
So the two lawyers are having a heart-to-heart today. If something constructive comes out of it, peachy keen. Otherwise we're looking at getting trial dates.
In early 2013. If we're lucky.
