When your criminal lawyer, who has 32 years' experience, tells you not to talk to the police without counsel present, don't talk to the police without counsel present.

When your free dial-a-lawyer, whose experience you are unsure of, tells you not to talk to the police without counsel present, don't talk to the police without counsel present.

Hell, when the articling student tells you not to talk to the police without counsel present, don't talk to the police without counsel present.

When the law student working for the University of Ottawa Free Legal Clinic tells you not to talk to the police without counsel present, don't talk to the police without counsel present!

When your mom, who has watched a lot of Law & Order, tells you not to talk to the police without counsel present, don't talk to the police without counsel present!!

Are we seeing a theme here?

...

**plunging back into case law concerning things people have said to the police after being arrested**

**... and having already had their one phone call, in which counsel told them to for God's sake... any guesses?**

In my experience, some people just want to be arrested.

And charged. And convicted. If they're at the point you described, I guess they're already arrested!

Yeah, I don't know, sometimes it really seems like it. And the whole time I'm reading these cases I'm remembering guys I worked with on the inside, and how they were often sort of incredulous that they'd been convicted, like, "What did I do?! How did that happen?!"

Oy vey.

Being convicted is just a problem that happens to OTHER criminals...

Personally I think it's a good thing that most criminals aren't smarter.
